These Terms of Service (“Terms”) govern your use of the NextInvest website, platform, and services (“Services”). By accessing or using our Services, you enter into a legally binding agreement with NextInvest.

  1. Use of Services
  • Eligibility: You must have the legal capacity to enter into a contract under Belgian law.
  • Account Responsibility: You are responsible for safeguarding your account credentials. Any activity performed under your account is deemed your responsibility.
  • Compliance: You must use the Services in accordance with these Terms, Belgian law, and applicable EU regulations.
  1. Intellectual Property

All content, software, proprietary algorithms, AI models, trademarks, and materials provided by NextInvest remain the exclusive property of NextInvest or its licensors.

  • Restrictions: You are strictly prohibited from copying, modifying, reverse-engineering, or decompiling the software, or using the Services to develop a competing product or service.
  1. Customer Data & Intellectual Property License
  • A. Ownership: You retain all ownership rights to the data you upload or provide (“Customer Data”).
  • B. License to Process: You grant NextInvest a non-exclusive, royalty-free, worldwide license to process, host, and display Customer Data solely for the purpose of providing the Services and improving system accuracy.
  • C. Anonymization: In accordance with GDPR standards, we may use anonymized or aggregated data (which no longer constitutes “personal data”) for analytics and product development.
  1. Prohibited Activities

Users shall not:

  • Attempt unauthorized access to the platform or its underlying infrastructure.
  • Use the Services for any illegal activities or to distribute malicious code.
  • Use system outputs for competitor analysis or “scraping” to train secondary models without express written consent.
  1. Service Modifications & Availability

NextInvest reserves the right to modify or discontinue features to improve the service. For material changes affecting paid subscriptions, we will provide at least 30 days’ notice via the email provided.

  1. Warranty & Disclaimers
  • Service Standards: We provide Services with reasonable care and skill according to industry standards.
  • Disclaimer: While we strive for high accuracy, the Services are provided to assist professional judgment. To the extent permitted by Belgian law, we do not guarantee that the Services will be entirely error-free or uninterrupted. Outputs should be verified within your own quality assurance (QA) workflows.
  1. Limitation of Liability
  • Liability Cap: To the maximum extent permitted by Belgian law, NextInvest’s total liability for any claim arising out of these Terms shall not exceed the total fees paid by you in the 12 months preceding the incident.
  • Exclusions: We are not liable for indirect or consequential losses, such as loss of profit or data, except in cases of gross negligence, willful misconduct, or physical injury.
  1. Termination
  • By You: You may terminate your account at any time.
  • By Us: We may suspend or terminate access if you breach these Terms. Upon termination, your right to use the Services ceases immediately.
  1. Governing Law and Jurisdiction

These Terms and any disputes arising from them are governed by and construed in accordance with the laws of Belgium.

  • Jurisdiction: Any legal proceedings shall be brought exclusively before the courts of Brussels, Belgium, unless mandatory consumer protection laws dictate otherwise.
